Absolutely. Signing a contract without legal review is one of the most common — and costly — mistakes businesses make. If a contract is breached, you may be entitled to damages, specific performance (forcing the other party to fulfil their obligations), or rescission (cancellation). Verbal agreements can be enforceable in Kenya, but proving the agreed terms in court is extremely difficult without written evidence. Certain contracts — such as those involving land, guarantees and contracts not to be performed within one year — must be in writing to be enforceable. We always recommend putting commercial agreements in writing.
