Why You Need a Personal Injury Lawyer in Kenya

After an Accident, the System
Is Not on Your Side

Insurance companies have lawyers. Employers have lawyers. Hospitals have lawyers. Without your own advocate, you're likely to receive a fraction of the compensation you're legally entitled to — or nothing at all.

🚗
Insurance Companies Lowball Your Claim

Insurers are profit-driven. After a road accident or workplace injury, they'll pressure you into accepting a fast, low settlement — often a fraction of your true entitlement for medical expenses, lost income, pain and suffering. Once you sign, you can't go back. A lawyer ensures you receive full and fair compensation.

Strict Time Limits on Injury Claims

Under Kenya's Limitation of Actions Act, personal injury claims must generally be filed within 3 years of the injury. For fatal accident claims under the Fatal Accidents Act, the limitation period is even shorter. Missing these deadlines permanently bars your claim — regardless of how strong your case is.

📋
Evidence Disappears Quickly

CCTV footage is overwritten. Witnesses forget details. Medical records get lost. Police abstract reports need to be obtained promptly. The longer you wait to engage a lawyer after an accident, the harder it becomes to build a strong case for compensation. Early legal intervention is critical.

Accident & Personal Injury Services

Full-Spectrum Injury Compensation
Claims Across Kenya

  • 01
    Road Traffic Accident Claims

We handle compensation claims for victims of matatu accidents, motorcycle (boda boda) crashes, pedestrian knockdowns, hit-and-runs and multi-vehicle collisions. We pursue claims against negligent drivers, vehicle owners and their insurers — recovering damages for medical bills, lost wages, vehicle damage, pain and suffering and permanent disability.

  • 02
    Workplace Injury & Industrial Accidents

We represent workers injured on construction sites, in factories, on farms and in offices due to employer negligence, unsafe conditions or defective equipment. We pursue claims under the Work Injury Benefits Act (WIBA) 2007 and common law negligence — securing compensation for medical treatment, lost earning capacity and rehabilitation costs.

  • 03
    Medical Negligence & Malpractice

We pursue compensation for patients harmed by medical errors — misdiagnosis, surgical mistakes, birth injuries, anaesthesia errors and failure to obtain informed consent. We work with independent medical experts to establish breach of duty of care and quantify damages, taking claims against hospitals, clinics and individual practitioners.

  • 04
Fatal Accident & Wrongful Death Claims

We represent families who have lost loved ones through negligence — road accidents, workplace fatalities, medical errors and criminal acts. Under Kenya's Fatal Accidents Act (Cap 32) and the Law Reform Act, dependants can claim loss of financial support, funeral expenses and loss of consortium. We handle these sensitive cases with compassion and determination.

  • 05
    Public Liability & Premises Injury

We pursue claims for injuries sustained on commercial premises — slip-and-fall accidents in shopping malls, injuries from falling objects, lift/escalator malfunctions and unsafe building conditions. Property owners and occupiers owe a duty of care under the Occupiers' Liability Act (Cap 34), and we hold them accountable when they fail.

  • 06
    Product Liability Claims

We represent consumers injured by defective products — faulty machinery, contaminated food and beverages, dangerous pharmaceuticals and defective vehicles. We pursue manufacturers, importers and retailers under Kenya's Consumer Protection Act 2012 and the law of negligence, securing compensation for injuries caused by unsafe products.

  • 07
    Insurance Dispute Resolution

When insurers deny valid claims, delay payments or offer inadequate settlements, we take action. We handle disputes with motor vehicle insurers, WIBA insurers and medical insurance providers — through demand letters, complaints to the Insurance Regulatory Authority (IRA), negotiation and court litigation where necessary.

  • 08
Assault, Abuse & Criminal Injury Claims

Victims of assault, sexual abuse, police brutality and other intentional harm deserve compensation beyond the criminal justice process. We pursue civil claims for damages against perpetrators, institutions and — where applicable — the State, ensuring survivors receive financial redress for their physical and psychological injuries.

"After an accident, insurers work to minimise your payout. We work to maximise your compensation — every shilling you're legally entitled to."

How We Work

From Accident to Full Compensation

A proven, step-by-step process. We handle the legal fight so you can focus on recovery.

01
Free Claim Assessment

We assess the circumstances of your accident, evaluate the strength of your claim and advise on the compensation you could receive — at no cost or obligation.

02
Evidence Gathering

We collect police abstract reports, medical records, witness statements, CCTV footage, photographs and expert opinions to build an irrefutable case.

03
Demand & Negotiation

We issue a detailed demand to the insurer or liable party, supported by evidence and a robust damages calculation. Most claims settle at this stage.

04
Court Filing

If a fair settlement isn't offered, we file suit in Kenya's courts and litigate aggressively, presenting evidence, cross-examining witnesses and arguing for maximum damages.

05
Compensation Recovery

We enforce the court judgment or negotiated settlement, ensuring the compensation is actually paid into your hands — including pursuing execution proceedings if necessary.

How much compensation can I get for a personal injury in Kenya?
+

Compensation depends on the severity of your injuries, the impact on your earning capacity, your medical expenses, and the degree of pain and suffering. Kenyan courts award general damages (for pain and suffering) and special damages (for quantifiable losses like medical bills, lost wages and transport costs). Awards range from hundreds of thousands to tens of millions of shillings. We assess each case individually and fight for maximum compensation based on established court precedents.

How long do I have to file a personal injury claim in Kenya?
+

Under the Limitation of Actions Act (Cap 22), personal injury claims must generally be filed within 3 years from the date of the accident or the date you became aware of the injury. For fatal accident claims under the Fatal Accidents Act, the limitation period is 3 years from the date of death. Missing this deadline permanently bars your claim. We strongly advise contacting a lawyer as soon as possible after an accident to protect your rights.

What if the driver who hit me was uninsured or fled the scene?
+

If the at-fault driver is uninsured or unidentified (hit-and-run), you may still recover compensation. Claims can be made against the vehicle owner (who is jointly liable), and in certain circumstances, the Motor Vehicle Accident Fund or other statutory mechanisms may apply. We investigate every avenue of recovery to ensure you receive compensation even in difficult hit-and-run scenarios.

Do I have to go to court, or can we settle out of court?
+

Most personal injury claims in Kenya settle out of court through negotiation with the insurer. However, if the insurer refuses to offer fair compensation, we will not hesitate to file suit and take your case to trial. Our goal is always to achieve the best possible outcome for you — whether through settlement or court judgment. You decide; we advise and execute.

What is the difference between WIBA compensation and a common law claim?
+

WIBA (Work Injury Benefits Act 2007) provides a statutory compensation scheme for workplace injuries — it pays fixed amounts based on a schedule, regardless of fault. A common law negligence claim, by contrast, requires proving the employer was negligent but can result in significantly higher compensation covering full medical costs, loss of future earnings and pain and suffering. In many cases, injured workers are entitled to pursue both. We advise on the best strategy for your situation.

What does "No Win, No Fee" mean?
+

Under a "No Win, No Fee" (contingency fee) arrangement, you do not pay legal fees unless we successfully recover compensation for you. If we win, our fees are paid as an agreed percentage of the compensation recovered. If we don't win, you pay nothing. This arrangement ensures that access to justice is available to accident victims regardless of their financial situation. We offer this on qualifying personal injury cases after assessing the merits of your claim.
