The surviving spouse, children and dependants have priority. An administrator must apply for Letters of Administration at the court before any assets can be distributed. A will can be challenged in Kenya on several grounds including: undue influence, fraud, forgery, mental incapacity of the testator at the time of signing, improper execution (e.g. missing witnesses), or if the will unfairly excludes a dependant.
